Every year, hundreds of thousands of aliens from across the globe come to the United States through family based immigrant visas, employment based immigrant visas, as well as temporary non-immigrant visas. Permanent resident aliens enjoy entering and leaving the country in a way that would permit them to visit their home country or to do business overseas without much restrictions. Nevertheless, recent legislations seek to impose harsh sanctions against aliens by making it harder for them to enter and remain in the United States. This attitude is reflected in the Illegal Immigrant Reform and Immigrant Responsibility Act of 1996 (IIRIRA of 1996), the U.S. Patriot Act, and the recent immigration reform Bill, the Immigration Reform Act of 2007. Thanks to the foresight of our legislatures, the Immigration Reform Act of 2007 did not pass. Although the proposed law would have granted undocumented aliens in the U.S. an opportunity to become legalized aliens and paved the way to naturalization, it sought to change the way legal aliens have been entering the United States over the past 55 years, since the Immigration and Naturalization Act of 1952 (which is still in effect today), and that is through family based petitions and employment based sponsorship. The United States Citizenship and Immigration Services (hereinafter “USCIS”) continues to provide regulations that make it more difficult for aliens to become naturalized. The revised naturalization examination, which will take effect as of January 1, 2008, requires legal aliens to have knowledge and be able to respond to questions concerning the Constitution and history of the U.S., a task that the majority of the native-born Americans cannot answer themselves. Aliens in the United States will continue to face stricter immigration laws as this trend continues. Only when aliens obtain Naturalization are they free from laws and regulations that erode their due process rights, provided by the Constitution. Until such date, they are always in danger the xenophobic attitude of the general public. As the U.S. Supreme Court stated over 55 years ago:
